The Police are spreading the lie that they can breathalyse any driver at random and an offence is commited if you refuse even if you are stone cold sober.
In truth if they have no reasonable suspicion that you have been driving AND drinking,been in an accident or commited another moving traffic offence refusal is not an offence under section 6 of the Road Traffic Act 1988.
If you have been driving drunk or drugged up you deserve all you get but threatening the vast majority of law abiding motorists with a fine/ban if they refuse a breath test without the required suspicion is plainly wrong on legal as well as moral grounds.

    It is of course all in the wording. What the Police will do is stop people for "vehicle checks". Once stopped they may then decide that perhaps you have been drinking and therefore seek a breath test.

    It does however seem a bit of a sledge hammer to crack a nut approach. What's really required is to allow tests to be made on drivers who are believed to be heavy drinkers to demonstrate that tey are regularly driving over the limit particularly the next day.

    I am sure there is a hard core of people who drink and drive on the basis that the chances of getting caught are very limited. A targetted campaign against those suspected of regularly breaking the law will have an affect on them as well as those that may occaionally risk it.
